To conclude the purchase contract for one or more products on the site, the user must fill in an order form in electronic format and send it to Dionigi Castagnoli, electronically, following the instructions that will appear from time to time on the site and which will accompany the different phases of the purchase.
The order form contains a summary of the information on the essential characteristics of each product ordered, the relative price, including all applicable taxes or duties for shipments in Italy, the means of payment to purchase each product, the delivery methods of the products purchased and the shipping costs.
The contract will be concluded when Dionigi Castagnoli confirms the order sent by the customer , after verifying the correctness of the data relating to the order itself and the payment.

The Customer will pay the full price of the items ordered according to the methods indicated in this section, together with the forwarding of the Purchase Order.

With the receipt of the aforementioned e-mail, the Customer and www.dionigicastagnoli.com accept that the Purchase Order is considered irrevocable without prejudice to the right of withdrawal referred to in the following Section and these Conditions of Sale.
If the Products are to be delivered to a country that does not belong to the European Union, the total price indicated in the order and reiterated in the order confirmation, inclusive of indirect taxes (if applicable) is net of any customs duties and any other sales tax, which the Consumer hereby undertakes to pay, if due, in addition to the price indicated in the order and confirmed in the order confirmation, in accordance with the provisions of the law of the country in which the Products will be delivered . The Consumer is invited to inquire with the competent bodies of his country of residence or destination of the Products, in order to obtain information on any duties or taxes applied in his country of residence or destination of the Products.

In any case, the Customer, with the acceptance of our terms of use, exonerates www.dionigicastagnoli.com from any responsibility in this regard. For shipping, the address provided during registration on the site will be used, so carefully fill in the complete address field in all its parts.
www.dionigicastagnoli.com will not be responsible for failed or delayed delivery even if:
(a) despite having provided for the regular and timely purchase of the Products to cover the Purchase Order received, it has not been replenished within the terms and conditions agreed with the supplier;
(b) is unable to make up for the unavailability of the Products ordered and has promptly notified the Customer of the unavailability of such Products within 48 working hours.
In case of unavailability of an article, www.dionigicastagnoli.com will refund the customer the advance payments of the price within 30 (thirty) days from the day of receipt of the payment.
Furthermore, www.dionigicastagnoli.com will not be responsible for failed or delayed delivery due to force majeure, such as – by way of example – strikes, provisions of the Public Authority, rationing or shortage of energy or raw materials, transport difficulties, fires, floods and damage to industrial machinery not due to the fault of www.dionigicastagnoli.com. www.dionigicastagnoli.com will promptly notify the Customer of the occurrence and disappearance of a cause of force majeure. If the cause of force majeure persists for a period exceeding 4 (four) weeks, each of the parties will have the right to withdraw from the contract. In the event of withdrawal pursuant to this section, the Customer will not be entitled to any indemnity or compensation for any reason, except for the right to a refund of any amount already paid as a price.
5.4 In the event of a purchase made by a Consumer, the risk of accidental loss of the article remains with www.dionigicastagnoli.com until delivery of the article itself to the Consumer or to another person indicated by the latter, regardless of whether the shipment of the article itself is or is not insured. In the event of a purchase made by a person other than a Consumer, the risk of accidental loss of the item passes to the Customer with the delivery of the item by www.dionigicastagnoli.com to the first carrier . The Site indicates the availability of the Products and their delivery times, however, such information is to be considered purely indicative and not binding for the Seller.
The Seller undertakes to do everything in its power in order to respect the delivery times indicated on the Site and, in any case, to carry out the delivery within a maximum time of 30 (thirty) days starting from the day following the one in which the Consumer has sent the order. In the event of non-execution of the order by the Seller, due to the unavailability, even temporary, of the Product, the Seller will provide written notice to the Consumer and will refund any sums already paid by the Consumer for payment of the Product pursuant to the following paragraph. If the Consumer has chosen the bank transfer as payment method, the delivery term will start from the receipt of the payment by the Seller.
The shipment of the Products ordered by the Consumer will take place in the manner selected by the Consumer, among those available and indicated on the Site at the time the order is sent. The Consumer undertakes to check promptly and in the shortest possible period that the delivery includes all and only the Products purchased and to promptly inform the Seller of any defect of the Products received or of their discrepancy with respect to the order placed, according to the procedure of referred to in the following paragraph of these Conditions, failing which, the Products will be considered accepted. If the packaging or casing of the Products ordered by the Consumer should reach its destination clearly damaged, the Consumer is invited to refuse delivery by the carrier/shipper or to accept delivery "with reserve". The ordered products will be sent to the postal address specified by the user in the registration form. Deliveries will be made from Monday to Friday, during normal office hours, excluding national holidays. Delivery will be made within 7 working days from the day of receipt of the order. Delivery is considered complete when the product is made available to the user at the address specified in the registration form. It is mandatory for the user to indicate a telephone number. If the telephone number is not present, for direct shipments to private customers, after the second notice left, the courier will not contact the recipient and for deliveries by appointment will carry out the delivery on the requested date or according to the terms of surrender agreed without prior phone call. It is up to the user - recipient - to check the condition of the delivered product.
The user who has purchased products through the site www.dionigicastagnoli.com has the right to withdraw from the contract concluded with Dionigi Castagnoli within 14 days from the date of receipt of the goods, as required by Legislative Decree n. 206 of 2005, Consumer Code. The user who wishes to return or replace an item can send an e-mail to dionigi@dionigicastagnoli.com with his request. Dionigi Castagnoli is not responsible for the cost of return or exchange shipping, unless the item has a defect recognized by Dionigi Castagnoli. Dionigi Castagnoli will refund the value of the product by issuing a credit note or a receipt for the return of the goods.
As for the right of withdrawal, the following is specified:
The user must be a private person.
The product, even if opened, must be like new, therefore intact, with complete packaging and in perfect condition, with all accessories, packaging and unused. All returned items will be duly checked. In the case of products that do not meet these characteristics, Dionigi Castagnoli reserves the right to refuse the return or to apply a reduction on the price. The withdrawal can be exercised within 14 days from the date of receipt of the goods by e-mail to the e-mail address dionigi@dionigicastagnoli.com.
A communication will follow from Dionigi Castagnoli with an indication of how to return the product which must in any case be sent within 14 days of receipt of the goods to the Dionigi Castagnoli Company, Via Galileo Galilei 10, 27026 Garlasco (Pv). If the right of withdrawal is exercised following the methods and terms indicated, Dionigi Castagnoli will reimburse the sums already collected for the purchase of the products but not the shipping costs. The return shipment is carried out directly by the user at his own expense by sending the package within 14 days of receiving the goods in the manner and to the address indicated by Dionigi Castagnoli. The sums to be refunded will be processed as quickly as possible and, in any case, within thirty days from the date on which the seller became aware of the exercise of the right of withdrawal and once the correct execution of the terms and conditions indicated above has been verified . If the methods and terms for exercising the right of withdrawal are not respected, the user will not be entitled to a refund of the sums already paid to the seller.
The shipping costs for returning the product are completely borne by the user. In the event of loss or damage to the products during transport, whether due to the user's negligence or to a choice of carrier and/or shipping methods, the responsibility will rest with the user who made the withdrawal.
The law applies to the product in its entirety and totality. It is not possible to exercise the right of return on individual parts of the purchased product.
If the Customer has made use of his Right of Withdrawal in the manner specified in the previous paragraph "Right of Withdrawal", he can make use of the right to replace the product, if he does not wish to receive a refund.
To replace the Product, the Customer must specify in the e-mail in which he intends to withdraw from the contract (paragraph) his willingness to replace the returned product with one of the same amount or the same in different modifications, specifying the number of the item chosen to replace the one in the previous Purchase Order. All replaced products must be equal to or greater than the amount returned. In case of multiple orders, the reference price refers to the cost of the single or multiple items added at the time of the Purchase Order. Any price changes subsequently applied to the items purchased within the Purchase Order for which replacement is requested will not be counted.
Following receipt by e-mail of the Customer's intention to exercise the right of replacement and having seen that each part is correct in the price or availability of the Product, www.dionigicastagnoli.com will open the procedure for replacing the Product with that requested by the customer. The Customer must then send the item to be replaced to Dionigi Castagnoli with a courier of his choice and at his expense, as specified in paragraph 7 – 7.2 paragraph c) and following -. Modification and Replacement

Therefore, you may modify the Product, where possible and if the Product lends itself or is suitable to lend itself, according to your fit and needs.

Once all the necessary modifications and the cost of such modifications have been agreed with the Client, the Client can proceed with the Purchase of the Product in the manner indicated on the site and subsequently www.dionigicastagnoli.com will deliver the requested Product to the courier within 6 (six ) following working days.
Any additional costs for modifications and alterations to the product are to be agreed in advance between www.dionigicastagnoli.com and the Customer before placing the Purchase Order and will eventually be invoiced separately from the Purchase Order placed on www.dionigicastagnoli.com Product delivery times depend on the courier and as indicated in paragraph 5. Shipping.
If the Customer has made use of his right of withdrawal by requesting the replacement of the product, he may replace the Product by modifying it according to his needs where it lends itself to such modifications in terms of specifications and properties. WARRANTY FOR DEFECTIVE GOODS:

• Reference of the order and shipment number;

Once the defect of the returned goods has been ascertained, www.dionigicastagnoli.com will open a refund procedure for the cost of the goods or, if you prefer, a new shipment of the damaged goods. All always at our expense.
In the event of a new shipment of the damaged goods, www.dionigicastagnoli.com will arrange to ship said item within 6 working days following receipt of the damaged goods (as per section 5 "Shipping").
WARRANTY AND RETURNS HANDLING:
The legal provisions regarding the guarantee apply to purchases made by the Customer.
The color of the garments may not be rendered faithfully from the photographs on the site and a lot also depends on the type of graphics card in your computer. It is therefore possible that the garments have slightly different shades of color from those you will see represented on your computer screen.
In the event of a defect or serious discrepancy of the products purchased with respect to the description published on www.dionigicastagnoli.com, the user has the right to have the product replaced, without any additional expense, where this is possible in relation to the number of pieces still available for sale. Alternatively, the Customer has the right to terminate the contract, in this case Dionigi Castagnoli will return the total amount paid to the user, consisting of the purchase price and shipping costs. In any case, the amount and method of reimbursement will be communicated to the user by e-mail. The Customer must agree with the Customer Service the methods of shipment of the goods to be returned.

Dionigi Castagnoli is not responsible in the event of any damage to the Product, to persons or things, deriving from the use of the Product improperly and/or not in compliance with the maintenance instructions provided by the Manufacturer as well as in the event of damage deriving from unforeseeable circumstances or force greater.

The general conditions of sale are governed by Italian law specifically by Legislative Decree 6 September 2005 n. 206 (so-called Consumer Code), by the legislation on distance contracts and by Legislative Decree 9 April 2003 n.70 on certain aspects concerning electronic commerce. Dionigi Castagnoli is not responsible in case of damages, of any nature whatsoever, deriving from the use of the product improperly and/or not in compliance with the instructions provided by the manufacturer as well as in case of damages deriving from unforeseeable circumstances or force majeure. Dionigi Castagnoli reserves the right to temporarily suspend, without any prior communication, the provision of its services for the time strictly necessary for the necessary and/or appropriate technical interventions to improve the quality of the services themselves. The general conditions can be modified at any time. Any changes and/or new conditions will be effective from the moment of their publication on the site, with an indication of the effective date of the changes themselves, which must be at least 30 days after the date of publication on the site. Any total or partial reproduction, any modification or use of these trademarks, for any reason and by any means, in the absence of prior express and written consent is strictly prohibited and will be pursued in the appropriate forums.
